1. Acceptance of Terms
By downloading, installing, or using the illastratum application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and illastratum ("we," "us," or "our").
2. Description of Service
illastratum is a social platform for book lovers that provides:
- Social networking features for readers, including friend connections, following influencers, and group memberships
- The ability to create, share, and interact with posts about books
- The ability to follow influencers and see their posts in your feed
- AI-powered image generation from book text (available with a subscription)
- E-book reading capabilities
- Group management and discussion features
3. Account Registration
To use the App, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
You must be at least 13 years of age to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
4. Subscriptions and Payments
4.1 Auto-Renewable Subscriptions
illastratum offers auto-renewable subscription plans that provide access to premium features including AI image generation credits and group management capabilities.
- Monthly Plan: Billed monthly. Includes 1 group (100 members) and 50 AI images per month.
- Yearly Plan: Billed annually at a discounted rate. Includes the same features as the monthly plan.
4.2 Billing
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your device's account settings after purchase
4.3 Add-On Purchases
Additional features are available as in-app purchases for active subscribers, including extra image credits, additional group slots, and member expansion packs.
4.4 Free Trial
If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.
4.5 Refunds
Refunds are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies.
5. User Content
5.1 Your Content
You retain ownership of content you create and share on illastratum, including posts, comments, and profile information. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.
5.2 AI-Generated Images
Images generated using the AI features are created based on your inputs. You are responsible for ensuring your prompts and generated content comply with these Terms and applicable laws.
5.3 Prohibited Content
You may not post content that:
- Is illegal, harmful, threatening, abusive, harassing, or defamatory
- Infringes on intellectual property rights of others
- Contains sexually explicit material or promotes violence
- Constitutes spam, phishing, or malware
- Impersonates another person or entity
- Violates any applicable law or regulation
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.
7. Intellectual Property
The App and its original content, features, and functionality are owned by illastratum and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
8. Termination
We may suspend or terminate your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may delete your account at any time through the App's profile settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ILLASTRATUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
